Over the last two years we have been following CARB through draft regulation documents, webinars and workshops, and numerous phone calls to arrive at a draft rulemaking document that will drastically change the LCFS program.
At 5pm today, February 20th, CARB will release a preliminary draft of the proposed rulemaking documents which they note will cover a number of topics including:
- Revising the LCFS program carbon intensity targets and extending the program
- Allowing additional fuels and vehicle categories to participate in the program
- Incorporating a carbon capture and sequestration protocol
- Promotion of zero emission vehicle infrastructure
- Addition of a third-party verification of CI values and fuel transactions
- Addition and update of GHG accounting tools including simplified calculator tools
- Streamline the process for fuel pathway applications
- A few other miscellaneous topics
The copy released today will not be the official proposed rule and is still subject to change per the Office of Administrative Law review. The official proposal is set to be released on March 6, 2018 with the public comment period opening on March 9, 2018.
We have been tracking this progress during our LCFS Implementation Series which is a series of emails we have been sending out monthly. Once the regulation is finalized, the email series will transition to “what has changed” and “tips” relating to LCFS. Our experts are planning immediate reviews of the preliminary draft in order to identify any major areas that may still need to be addressed through the public comment period. Our review and update will have a large focus on the addition of the third-party verification requirements, but will also make note of some other important areas in the regulation.
